Payment taken in Cash, Cheque (made out to Phillip Betts), Interac e-Transfer or PayPal

Payment is due immediately upon completion of work

Please Note: I am certified to work with low-voltage electronics systems (e.g. 5, 12 and 24 volts). Under BC legislation (BC Electrical Code), I can provide consultation for 110/220 volt AC system design, but all 110/220 volt AC electrical “service” connections must be made by the client or by a certified electrician, and inspected by BC Safety. I can coordinate referrals and inspections upon request.

Important: Sometimes replacing a failed electronic component can burn out the other original weakened components when power is restored. I will do my best to get your electronics up and running safely, but there is always a risk of permanent damage and/or catastrophic failure, including electrical shock and fire. By hiring me to work on your electronics, you agree that you are aware of the risks and you take full responsibility for any damages that may result.

If you engage me for consulting services or project management, I will provide you with a written contract.

Due to the uncertain nature of electronic diagnostics, I can only provide approximate estimates for electronic repair, design, and builds.

I will obtain your verbal approval before going ahead with a repair if it takes more than the 1 hour minimum.

Terms and Conditions:

I authorize TechExpert technician(s) to perform service work on my electronic and/or computer device(s). I understand that TechExpert technician(s) have been trained to perform work on many makes and models of SmartPhones, Tablets, Laptops, Desktops, TVs, Amplifiers, Speakers, Electronic Keyboards, Smart Devices, Marine Electronics, Printers, Projectors, Wireless Communications, Security Devices, Home Theater Components, Tube Radios, Solar Panel Systems and Wind Turbine Systems.

I agree to release, indemnify, and hold TechExpert from all liability for any claims and/or damages of any kind or description that may arise from any repair work performed on my software and/or electronic device(s).

I understand that TechExpert is not responsible for any data loss, which may occur as a result of work done on my software and/or electronic device(s). I also understand that I have the option to, and I am responsible for backing up the device(s) before allowing any repair to be performed on my device(s) in the event of any data loss and hardware and/or software failure.

I understand that TechExpert will not browse through any personal, private or confidential information or data; however, technicians may inadvertently see data
during the course of their work. I understand that any confidential data should be removed from the device prior to having repair work performed on the device.

I understand that repairs or technical support performed by TechExpert may void manufacturer warranties, especially in the case of iOS device repairs. TechExpert and its affiliates do not assume any liability or warranty in the event that the manufacturer warranties are voided.

TechExpert is an private aftermarket service center and not a manufacturer authorized service center.

Estimated Completion Time: TechExpert will provide an estimated completion time for your equipment service and will contact you once work is complete. Please call if you require an updated estimated completion time. Unforeseen circumstances may have an impact on our ability to complete the repair(s) as provided in the estimate. Availability and shipping times for replacement parts may delay or impede the repair of the device.

Impact of Upgrades : Please be advised that it is your responsibility to understand the impact of upgrades to the operating system, applications and utility software. Such upgrades can lead to incompatibilities and the possible loss of data. Computer hardware and software work together and incompatibility may not become apparent until a later date. You are responsible for contacting the manufacturer of your software regarding compatibility issues before you request any upgrades.

Right to Refuse: In its sole discretion, TechExpert reserves the right to refuse work that it believes is beyond the scope of its ability or for other good cause.

Scope of Work: TechExpert will only perform the work agreed upon when you bring your equipment in for repair. You must authorize, in writing, any additional work which may be required.

Abandonment: If you do not pick up your equipment within ninety (90) days after we notify you that the requested service is complete, we will treat your equipment as abandoned. You agree to hold the TechExpert harmless for any damage or claim for the abandoned property. Any and all charges are still your responsibility. The device(s) will automatically be forfeited and disposed of.

Severability: You and TechExpert agree that it is our intention that these Terms and Conditions be enforceable in accordance with their terms to the fullest extent permitted by law. You and TechExpert agree that if any portion of these Terms and Conditions are adjudged by a court or arbitrator to be invalid or unenforceable, that adjudication will not invalidate the remainder of these Terms and Conditions and they will be fully enforceable.

Applicable Law & Dispute Resolution: The formation, existence, construction, performance, validity and all aspects whatsoever of these Terms and Conditions will be governed by the laws of the Province of British Columbia, without reference to its choice of laws principle; ALL DISPUTES WITH TECHEXPERT ARISING IN ANY WAY FROM THE SERVICE, INCLUDING THE ISSUE OF ARBITRABILITY, WILL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, AND NOT BY A COURT OR JURY. Any such dispute will not be combined or consolidated with a dispute involving service provided to any other person or entity, and specifically, without limitation of the foregoing, will not under any circumstances proceed as part of a class action or class arbitration. The arbitration will be conducted before a single arbitrator, whose award may not exceed, in form or amount, the relief allowed by the applicable law. The venue for all arbitrations will be in Nanimo, BC. The arbitration will be conducted according to the American Arbitration Association (AAA) Commercial Arbitration Rules applicable to consumer disputes, and is entered pursuant to the Federal Arbitration Act. The arbitrator will decide all issues of interpretation and application of this arbitration provision and the Terms and Conditions. Judgment may be entered on the arbitrator’s award in any court of competent jurisdiction. This arbitration provision also applies to claims against TechExpert employees, representatives and affiliates if any such claim arises from the Service.

Changes to Terms of Service: TechExpert reserves the right, at any time, to modify the terms this Terms of Service, by making those modifications available on this website or by providing notice to you. Any modification will be effective immediately upon posting on this website or other such notice. You are deemed to have agreed to such modification through your continued use of the products or services.

Waiver and Severability: TechExpert’s failure to enforce a provision is not a waiver of its right to do so later. If a provision is found unenforceable, the invalidity of such provision will not affect the remaining provisions of these Terms of Service, and all provisions not affected will remain in full effect to the fullest extent possible consistent with the intent of the parties.

Copyright: Except for material in the public domain under Canadian copyright law, all material contained on the website (including all software, HTML code, Java applets, Active X controls and other code) is protected by Canadian and foreign copyright laws. Except as otherwise expressly provided in this Terms of Service, you may not copy, distribute, transmit, display, perform, reproduce, publish, license, modify, rewrite, create derivative works from, transfer, or sell any material contained on the website without the prior consent of TechExpert None of the material contained on the website may be reverse-engineered, disassembled, decompiled, transcribed, stored in a retrieval system, translated into any language or computer language, retransmitted in any form or by any means (electronic, mechanical, photo reproduction, recordation or otherwise), resold, or redistributed without the prior written consent of TechExpert. Violation of this provision may result in severe civil and criminal penalties.

Also it is the nature of some components that they will not work properly after being repaired in a reasonable procedure. Also some manufacturers, including Apple Corp., have designed in and placed inside their devices, circuits and components that will intentionally “break” if repairs are attempted and do not advertise these “features” to the public and repair technicians. I will do my best to get your electronics up and running safely, but there is always a risk of permanent damage and/or catastrophic failure, including electrical shock and fire. By hiring me to work on your electronics, you agree that you are aware of the risks and you take full responsibility for any damages that may result.
